1. Binding Agreement
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and DIGITAL THRILL SRL, a company registered in Romania (“Company”, “we”, “us”), governing your access to and use of Visoria (visoria.app) (the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts. The Service is intended exclusively for parents or legal guardians.
3. Nature of the Service
Visoria is an AI-powered storytelling platform that generates personalized stories based on information submitted by a parent or legal guardian.
Stories are automatically generated using artificial intelligence systems without human editorial review.
4. Explicit AI Risk Disclosure
You acknowledge and agree that:
- Stories are generated by artificial intelligence.
- Outputs may contain fictional, inaccurate, incomplete, biased, or unpredictable content.
- The Service does not provide educational, medical, psychological, parenting, or therapeutic advice.
- Content suitability is solely your responsibility.
The Company makes no representations or warranties regarding accuracy, reliability, or appropriateness.
5. Parental Responsibility
You are solely responsible for reviewing all generated content before presenting it to a child and for supervising any interaction with the content.
The Company is not responsible for how content is interpreted, used, or relied upon.
6. Digital Delivery & Waiver of Withdrawal (EU Users)
By purchasing digital content, you:
- Expressly request immediate digital delivery.
- Acknowledge delivery begins immediately.
- Waive your statutory right of withdrawal once delivery begins, to the extent permitted by law.
7. Payments & Subscriptions
Payments are processed via Stripe. We do not store payment credentials.
Subscriptions automatically renew unless canceled before renewal.
Digital purchases are non-refundable except where required by mandatory law.
8. Intellectual Property
All platform technology, branding, software, and materials are owned by DIGITAL THRILL SRL.
Generated stories are licensed to you for personal, non-commercial use only.
You may not resell, redistribute, sublicense, or commercially exploit content.
9. Prohibited Conduct
- Submitting unlawful, harmful, or abusive input
- Attempting reverse engineering
- Scraping or automated extraction
- Interfering with platform security
10. Story Retention
Stories and associated inputs are automatically deleted after 60 days. Users are responsible for downloading their content.
11. Indemnification
You agree to indemnify and hold harmless DIGITAL THRILL SRL from any claims, damages, losses, liabilities, and expenses arising from:
- Your submitted input
- Your use of generated content
- Your violation of these Terms
- Claims relating to child interaction with content
12. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.
13. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- We are not liable for emotional, psychological, or developmental outcomes.
- Total liability shall not exceed the amount paid by you in the preceding 12 months.
14. Arbitration Agreement (US & Global Users)
Any dispute arising from these Terms shall be resolved by binding arbitration on an individual basis, except where prohibited by mandatory law.
You waive the right to a jury trial and participation in class actions.
15. Class Action Waiver
You agree that disputes shall be resolved individually and not as part of any class, consolidated, or representative action.
16. Export Compliance
You agree to comply with all applicable export control laws and regulations.
17. Force Majeure
We are not liable for delays or failures resulting from causes beyond our reasonable control.
18. Governing Law
These Terms are governed by Romanian law, without regard to conflict-of-law principles.
19. Severability
If any provision is found unenforceable, the remainder shall remain in effect.
20. Entire Agreement
These Terms constitute the entire agreement between you and DIGITAL THRILL SRL regarding the Service.
